Practice

The practice is limited to the Construction Industry and construction related matters and clients. Representation includes Owners, Developers, Sureties, General Contractors, Subcontractors, Suppliers, Factors, Architects, Engineers, Construction Industry Associations, and other Industry participants.

Litigation representation includes litigation, arbitration, and mediation before federal and state courts, Boards of Contract Appeals, federal and state administrative agencies, and the American Arbitration Association.

Litigation services are provided for complex litigation matters, including defects, scheduling, performance, delay, and disruption claims; mechanics lien claims; Pre-Liens and Notice of Contract and Notice of Subcontract preparation and filing; payment bond claims, including both federal Miller Act and "little Miller Act" state claims; parallel prime claims; administrative citation defense including NCDENR; Initial Decision Maker ("IDM"); creditor representation in bankruptcy adversary proceedings; collections involving performance issues and simple collections; bid protests; licensing defense; insurance issues; commercial transaction disputes; high dollar residential projects; and, typical construction industry contract disputes. Other matters include representation regarding Overseas and Tribal Nation Construction Projects.

Non-litigation services include construction industry contract drafting, review, and negotiation; construction project review and evaluation; arbitrator, mediator, and dispute review board services; arbitration hosting; association for local counsel representation; education of corporate personnel on legal issues in the construction industry including notice of contract services and lien and bond procedures and deadlines; consultation with out of state companies entering the North Carolina market; seminar presentation and articles on a wide range of topics for associations and companies; board representation for associations; employment claim defense; and, typical general corporate counsel services for construction companies, including stock transfers and corporate formation.
